The short version. Xome is a local-first tool you run with your own model keys, your own connected accounts, and your own wallet. You’re in control, and you’re responsible for what you do with it. The software is provided as-is, with no warranties. AI can be wrong, and crypto transactions are final and irreversible, you use both at your own risk. To the fullest extent the law allows, we are not liable for any losses arising from your use of Xome.
These Terms of Service (“Terms”) are a legal agreement between you and Xome (“Xome”, “we”, “us”) governing your use of the Xome web app at app.xome.bot and the website at xome.bot (together, the “Service”). By accessing or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.
1. Eligibility
You must be at least 18 years old and legally able to enter into these Terms to use the Service. By using Xome you represent that you meet this requirement and that your use complies with the laws that apply to you, including any laws governing cryptocurrency in your jurisdiction.
2. What Xome is
Xome is local-first software that runs in your browser. It lets you use AI models (on-device or your own cloud keys), connect your own third-party accounts, and operate a non-custodial crypto wallet. We provide the software; we do not provide the AI models, the connected services, the blockchain, or custody of any funds. We do not store your content on our servers.
3. Your responsibilities
You are responsible for your API keys, connected accounts, credentials, wallet, and all activity carried out through the Service. You are responsible for reviewing and approving actions before they run, for keeping your device and secrets secure, and for complying with the terms, usage limits, and policies of every third-party service you connect or use through Xome. You must not use the Service for anything unlawful, abusive, or infringing, or to violate the rights of others.
4. AI output
AI models can produce inaccurate, incomplete, or misleading output, and may take actions that don’t match your intent. You are responsible for reviewing AI output and any actions before relying on them. Xome does not provide legal, financial, tax, medical, or other professional advice, and nothing produced through the Service should be treated as such.
5. Crypto & financial risk
Xome’s crypto features are non-custodial: you alone control your wallet and funds, and we never hold, control, or can recover your keys or assets. Blockchain transactions, including transfers and swaps, are final, irreversible, and public once submitted; a mistaken address, amount, or swap cannot be undone. Digital assets are volatile and may lose value. Swap rates, routing, and execution are provided by third-party protocols (such as the Jupiter aggregator) over networks we don’t control, and outcomes are not guaranteed. Xome is not a broker, exchange, wallet custodian, or financial advisor, and provides no investment advice. You are solely responsible for your transactions, for any taxes, and for all associated risk and loss.
6. Third-party services
The Service connects to third parties you choose, AI providers, the apps you link, MCP servers, the wallet provider, RPC providers, and DEX aggregators. Your use of those services is governed by their own terms, and they are solely responsible for their own products. We do not control and are not responsible for third-party services, their availability, or their actions.
7. Intellectual property
Xome and its software, design, and branding belong to us. You retain ownership of your own data and content. You may not copy, resell, reverse-engineer, or attempt to disrupt or misuse the Service except as permitted by applicable law.
8. As-is; no warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, availability, security, or accuracy. We do not warrant that the Service will be uninterrupted, error-free, or secure.
9. Limitation of liability
To the fullest extent permitted by law, Xome and anyone involved in creating or operating it will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, funds, digital assets, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Service, including losses from AI output, crypto transactions, third-party services, or unauthorized access. To the extent any liability cannot be excluded, our total aggregate liability for all claims is limited to the greater of the amount you paid us for the Service in the past twelve months or USD 100.
10. Indemnification
You agree to indemnify and hold harmless Xome from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content or transactions, or your violation of these Terms or of any third party’s rights or applicable law.
11. Changes & availability
The Service is under active development and may change, be limited, or be discontinued at any time without notice. We may update these Terms from time to time; when we do, we’ll revise the date above, and your continued use of the Service means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of India, without regard to conflict-of-law rules, and you agree to the exclusive jurisdiction of the courts located in India for any dispute arising from these Terms or the Service, to the extent permitted by applicable law.
